3. Eligibility to Place an Order
You must be at least 18 years old and legally capable of entering into a binding contract to place an order with Foiled Forever.
If you submit personal information, images, handprints, footprints or other materials relating to another person, including a child, you confirm that you have the authority or appropriate permission to provide those materials to us for the purpose of fulfilling your order.
4. Our Products
Foiled Forever creates personalised and, in many cases, handmade or individually finished keepsakes.
Because of the nature of our products, slight variations may occur between:

These minor variations are part of the nature of personalised and individually produced items and do not necessarily constitute a fault.
This does not affect your statutory rights where a product is faulty, damaged, not as described or otherwise does not conform to the contract.

Many Foiled Forever products are created specifically for an individual customer.

Customers are responsible for providing accurate personalisation information.
Please check all information carefully before submitting your order.
Foiled Forever is not responsible for errors contained in information supplied by the customer, including:

Incorrect spelling

Incorrect names

Incorrect dates

Incorrect birth details

Incorrect wording
-
Incorrect measurements

Incorrect image selection
Where we have reproduced the information supplied by the customer accurately, the resulting product will not normally be considered faulty solely because the customer later identifies an error in the information they provided.
6. Customer-Supplied Handprints and Footprints
Customers may submit handprints and footprints through methods approved by Foiled Forever.
These may include:

Scans

Inkless impressions
-
Images captured using a mobile phone

Digital files

Other approved formats
The quality of the finished keepsake depends partly on the quality of the source material supplied.
For best results, customers should provide:

Clear images

Good lighting

Sharp focus

Minimal shadows
-
The complete print visible
-
The image taken as straight-on as reasonably possible
-
The highest available image resolution
Foiled Forever may contact the customer if a submitted image is unsuitable or likely to produce a poor-quality result.
7. Artwork Cleaning and Digital Preparation
As part of our service, Foiled Forever may digitally prepare customer-supplied handprints, footprints or images.
This may include:

Removing background marks

Removing obvious accidental smudges
-
Improving contrast
-
Improving clarity
-
Cleaning image edges
-
Adjusting positioning
-
Adjusting scale
-
Aligning prints
-
Separating prints
-
Combining prints
-
Preparing artwork for printing and foiling
Unless specifically agreed otherwise, our aim is to preserve the character and individuality of the original print while preparing it for presentation.
We will not intentionally make significant changes to the unique shape of a handprint or footprint without customer instruction or approval where appropriate.
8. Incomplete or Imperfect Prints
Handprints and footprints, particularly those taken from babies and young children, are naturally variable.
Prints may contain:

Gaps

Smudges
-
Light areas
-
Missing sections
-
Movement marks
-
Uneven pressure
-
Partial fingers
-
Partial toes
-
Distortion
Foiled Forever may make reasonable visual improvements where appropriate.
However, we cannot guarantee that missing parts of a print can be accurately reconstructed.
Where source material is incomplete, any requested reconstruction or artistic correction may involve interpretation.
Foiled Forever cannot guarantee that digitally reconstructed areas will exactly represent the original hand or foot.
9. Inkless Print Kits
Where Foiled Forever supplies an inkless print kit, customers must:

Follow the supplied instructions carefully

Use the kit only for its intended purpose

Ensure appropriate adult supervision

Keep kit components away from children except during properly supervised use

Follow any manufacturer safety information supplied with the kit

Handling
Foiled Forever cannot guarantee a perfect impression on every attempt.
Where an inkless kit is supplied by a third-party manufacturer, additional manufacturer instructions or warnings may apply.
10. Customer Responsibility for Submitted Materials
By submitting an image, photograph, handprint, footprint, design, text or other material to Foiled Forever, you confirm that:

You have the right to provide it

You have authority or appropriate permission to use it

Our use of it for your order will not knowingly infringe another person’s rights
-
It does not contain unlawful material
You grant Foiled Forever permission to use, reproduce, edit and process the submitted material only as reasonably necessary to:

Prepare your artwork

Create your personalised product

Fulfil your order

Provide customer service

Resolve production issues

11. Placing an Order
Orders may be placed through:

12. When a Contract Is Formed
Submitting an order does not necessarily mean that we have accepted it.
A contract between you and Foiled Forever is formed when we accept your order.

We reserve the right to refuse or cancel an order before acceptance where reasonably necessary.

All prices are displayed in pounds sterling (£) unless otherwise stated.
Prices will be shown as clearly as reasonably possible before an order is confirmed.

Any applicable additional charges will be communicated before the customer agrees to purchase them.
We reserve the right to change prices at any time.
Price changes will not normally affect orders already accepted, except where there has been an obvious pricing error.
14. Payment
Payment methods may vary depending on how an order is placed.

15. Deposits
For certain orders, Foiled Forever may accept a deposit.
Where a deposit applies, we will explain:

A deposit may become non-refundable once personalised design work, artwork preparation, sourcing of specific materials or production has begun, to the extent permitted by law and where this has been clearly communicated.
This does not affect your statutory rights.
16. Artwork Proofs
For selected personalised products, Foiled Forever may provide a digital artwork proof before production.
A proof may show:

Digital proofs are intended to help confirm the design before production.
They may not perfectly represent:

Exact foil reflectivity

17. Customer Approval of Proofs
Where a proof is provided, the customer is responsible for checking:

Spelling

Names

Dates

Birth details

Wording

Layout

Print selection

Orientation
-
Overall design
Once the customer approves the proof, production may begin.
After approval, changes may not be possible.
If changes are possible, additional charges and additional production time may apply.
Foiled Forever is not responsible for customer-supplied errors that were visible in an approved proof.
This does not affect your statutory rights where we fail to produce the item in accordance with the approved design.
18. Proof Revisions
Unless otherwise stated in the product description, the number of included proof revisions may be limited.
Additional revisions may incur an additional design fee.
Foiled Forever will communicate any additional fee before carrying out chargeable revision work.
A revision means a reasonable amendment to the existing design.
A request for a substantially different design may be treated as a new design request and may incur additional charges.
19. Production Times
Production times vary depending on:

Any production times shown are estimates unless we explicitly agree to a guaranteed deadline in writing.

Proof approval
Delays caused by missing customer information do not count as production delays by Foiled Forever.
20. Urgent Orders and Event Deadlines
If an order is required for a specific date, customers must tell us before placing the order.

Memorial dates

Other special occasions
We will confirm whether we believe the requested timeframe is achievable.
Unless expressly guaranteed in writing, delivery dates remain estimates.
Foiled Forever is not responsible for missed events where:

The deadline was not disclosed before ordering

The customer delayed approval

The customer delayed supplying prints or information

A courier experienced delays outside our reasonable control
21. Delivery
Delivery options and charges will be displayed or communicated before purchase where applicable.
Customers are responsible for providing a complete and accurate delivery address.
Foiled Forever is not responsible for delivery issues caused by incorrect or incomplete address information supplied by the customer.
If a parcel is returned because of an incorrect address or failed delivery, additional postage charges may apply before redelivery.
22. Delivery Times
Estimated delivery times are not guaranteed unless explicitly agreed otherwise.
Foiled Forever is not responsible for delays caused by events outside our reasonable control, including:

Postal disruption

Severe weather

Industrial action

Transport disruption

Natural disasters

Government restrictions

Other unforeseen events
Where a significant delay occurs, we will communicate with the customer and act in accordance with applicable consumer law.
23. Risk and Ownership
Responsibility for products passes to the customer in accordance with applicable consumer law.
Ownership of physical products passes to the customer once full payment has been received.
Nothing in this section limits any rights or protections that cannot legally be excluded.
24. Damaged Deliveries
Customers should inspect delivered products as soon as reasonably possible.

25. Cancellations

For non-personalised products purchased at a distance, statutory cancellation rights may apply.
For products made to the customer’s specifications or clearly personalised, statutory change-of-mind cancellation rights may not apply.
Nothing in these Terms removes any cancellation rights that apply by law.
26. Returns and Refunds
Returns and refunds are handled in accordance with:

For products purchased in person, change-of-mind rights may differ from those applying to online purchases.
Where a personalised order is placed at a market for later production, the customer is responsible for checking:

28. Photography and Social Media

We will not automatically use customer-submitted photographs or identifiable personal information for marketing simply because an order has been placed.
Where marketing content includes identifiable personal information, such as:

29. Intellectual Property
Unless otherwise stated, all Foiled Forever intellectual property remains owned by Foiled Forever or its licensors.

Purchasing a physical product does not automatically transfer copyright or intellectual property rights to the customer.
Customers may use purchased physical keepsakes for normal personal use.
Customers must not reproduce, resell, commercially exploit or copy Foiled Forever designs without written permission.
30. Customer-Supplied Intellectual Property
Customers retain any rights they hold in their own submitted materials.
By submitting materials to Foiled Forever, customers grant us a limited permission to use those materials as reasonably necessary to:

Edit the artwork

Produce the product

Communicate about the order

Resolve customer service issues
This permission does not automatically allow Foiled Forever to use customer materials for unrelated marketing.
31. Refusal of Orders
Foiled Forever reserves the right to refuse orders containing material that we reasonably believe is:

Discriminatory

Infringing

If an order is refused before production, an appropriate refund will be issued for amounts paid for unprovided products or services.

Customers are responsible for caring for finished products appropriately.
Foiled keepsakes and framed artwork should generally be:

Kept away from excessive heat
Foiled Forever is not responsible for damage caused by:

This does not affect rights relating to faults present at the time of supply.
33. Frames and Display Products
Where a product includes a frame:

Customers are responsible for ensuring that frames are displayed or mounted safely.

Nothing in these Terms excludes liability where it would be unlawful to do so.
34. Our Responsibility to You
Foiled Forever will provide products and services with reasonable care and skill where required by law.
We do not exclude or limit liability where it would be unlawful to do so.
Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence where liability cannot legally be excluded

Any other liability that cannot be excluded under applicable law
Subject to applicable law, Foiled Forever is not responsible for losses that were not reasonably foreseeable when the contract was formed.
35. Events Outside Our Reasonable Control
Foiled Forever is not responsible for failure or delay caused by events outside our reasonable control.

These Terms & Conditions are governed by the applicable laws of England and Wales.
If you are a consumer, you may also benefit from mandatory protections available under the law applicable to you.
Any disputes will be handled by the courts with jurisdiction under applicable law.
